The Gameplan

I'm with Digby on this one. Brad's proposed trajectory for the Supreme Court fight -- Bush nominates lunatic, Democrats filibuster, Bush withdraws lunatic, nominates crazy, Democrats celebrate bipartisanship -- strikes me as wrong. Bush doesn't want to lose round one of this fight. Maybe if he was still riding 58% approval ratings he'd give it a shot, nominating the nuttiest necromancer he could find, but at 43% he's going to try and stroke his base while wedging Democrats into an impossible position. How do you do that? Nominate a hardline conservative wrapped in an electorally important minority. Hence, Emilio Garza.

Democrats are going to be careful how they handle this. A lot of the country, including many liberals and independants are pretty upset about the Kelo decision. Since that decision was from the left side of the court, it will be easy for Republicans to use that to make Democrats look bad for objecting to a conservative judge.

Democrats can get some traction on abortion, but property rights will be an issue this time around I bet.

Heh. I somehow don't think the thoughts of other judges are going to be a big issue in picking the next judge.

There is a total fixation in today's discussion about the effects of a new nominee on Row v Wade. Yes, the TheoCons have to be fed, and a good meal too, but perhaps only in the context of a feast for the oil, pharma, logging, and other big-money biz interests.

The CorpCons will have an even bigger influence on the nominee chosen, than the TheoCons. They want less regulation and more freedom on economic issues that impact them. They have a huge fund in place to promote their position on the SCOTUS choice, and BushCo has shown great deference and consistence advocacy to these corporatists - even more than to the religious right, which tends to get stroked more than fed.

I disagree. I see two options.

1) Bush nominates "moderate" Gonzales. Gets credit from punditosphere for not succumbing to Christian right's demands. Democrats fail to muster support for filibuster, thanks largely to the useless nuclear option deal.

2) Bush nominates an utter loon - Brown, Pryor, Roy Moore or somebody like that. Democrates threaten filibuster. Republicans invoke nuclear option. Nutter wins vote.

We're fucked. Either way Bush gets the nominee he wants - a hardline conservative or a torture enabling loyalist.
